Dine køb er udelukkende underlagt returnering eller ombytning i overensstemmelse med vores Returpolitik.

AFSNIT 4 - PRISER OG FAKTURERING

Du erklærer og garanterer, at (i) de kreditkortoplysninger, du giver, er sande, korrekte og fuldstændige, (ii) du er behørigt autoriseret til at bruge det pågældende kreditkort til købet, (iii) gebyrer afholdt af dig vil blive accepteret af dit kreditkortselskab, og (iv) du vil betale de gebyrer, du har pådraget dig til de anførte priser, herunder forsendelses- og håndteringsgebyrer og alle gældende afgifter, hvis der er nogen.
AFSNIT 5 - FORSENDELSE OG LEVERING
Vi er ikke ansvarlige for forsendelses- og leveringsforsinkelser. Alle leveringstider er kun estimater og er ikke garanterede. Vi er ikke ansvarlige for forsekser forårsaget af fragtfirmaer, toldbehandling eller begivenheder uden for vores kontrol. Når vi overdrager produkterne til transportøren, overgår ejendomsretten og risikoen for tab til dig.
AFSNIT 6 - INTELLEKTUEL EJENDOMSRET
Vores Tjenester, herunder men ikke begrænset til alle varemærker, brands, tekst, visninger, billeder, grafik, produktanmeldelser, video og lyd, samt design, udvalg og arrangement deraf, ejes af Element Kunst, dets tilknyttede selskaber eller licensgivere og er beskyttet af ophavsret, varemærkeret og andre love om intellektuel ejendomsret.
Disse Vilkår giver dig kun tilladelse til at bruge Tjenesterne til din personlige, ikke-kommercielle brug. Du må ikke reproducere, distribuere, ændre, oprette afledte værker af, offentligt fremvise, offentligt udføre, genudgive, downloade, gemme eller transmittere noget af materialet på Tjenesterne uden vores forudgående skriftlige samtykke. Undtagen som udtrykkeligt angivet heri, giver intet i disse Vilkår, og skal ikke tolkes som at give, en licens eller andre rettigheder til dig under noget patent, varemærke, ophavsret eller anden intellektuel ejendomsret tilhørende Element Kunst, Shopify eller nogen tredjepart. Du må ikke bruge sådanne varemærker uden forudgående skriftlig tilladelse fra Element Kunst. Shopifys navn, logo, produkt- og servicenavne, design og slogans er varemærker tilhørende Shopify. Alle andre navne, logoer, produkt- og servicenavne, design og slogans på Tjenesterne er varemærker tilhørende deres respektive ejere.
AFSNIT 7 - VALGFRIE VÆRKTØJER
Du kan få adgang til tredjepartsværktøjer som en del af Tjenesterne, som vi hverken overvåger eller har nogen kontrol eller indflydelse på.
Du anerkender og accepterer, at vi giver adgang til sådanne værktøjer "som de er" og "som de er tilgængelige" uden nogen form for garantier, erklæringer eller betingelser og uden nogen godkendelse. Vi påtager os intet som helst ansvar som følge af eller i forbindelse med din brug af valgfrie tredjepartsværktøjer.
Enhver brug af de valgfrie værktøjer, der tilbydes via webstedet, sker helt på egen risiko og efter eget skøn, og du bør sikre dig, at du er bekendt med og godkender de vilkår, som værktøjerne leveres på af de relevante tredjepartsudbydere.

Alle personlige oplysninger, vi indsamler via Tjenesterne, er underlagt vores Privatlivspolitik, og visse personlige oplysninger kan være underlagt Shopifys Privatlivspolitik. Ved at bruge Tjenesterne anerkender du, at du har læst disse privatlivspolitikker.
Da Tjenesterne hostes af Shopify, indsamler og behandler Shopify personlige oplysninger om din adgang til og brug af Tjenesterne for at levere og forbedre Tjenesterne for dig. Vi er og skal ikke være forpligtet til (1) at holde din Feedback fortrolig; (2) at betale kompensation for din Feedback; eller (3) at svare på din Feedback.
Vi kan, men har ingen forpligtelse til, at overvåge, redigere eller fjerne Feedback, som vi efter eget skøn vurderer er ulovlig, stødende, truende, injurierende, ærekrænkende, pornografisk, obskøn eller på anden måde anstødelig, eller som overtræder nogens intellektuelle ejendomsret eller disse Servicevilkår.
Du accepterer, at din Feedback ikke vil overtræde nogen rettigheder tilhørende nogen tredjepart, herunder ophavsret, varemærke, privatliv, personlighed eller andre personlige eller ejendomsretlige rettigheder. Du accepterer endvidere, at din Feedback ikke vil indeholde injurierende eller på anden måde ulovligt, krænkende eller obskønt materiale, eller indeholde computervirus eller anden malware, der på nogen måde kan påvirke driften af Tjenesterne. Du må ikke bruge en falsk e-mailadresse, udgive dig for at være en anden end dig selv eller på anden måde vildlede os eller tredjeparter med hensyn til oprindelsen af enhver Feedback. Du er fuldt ud ansvarlig for den Feedback, du giver, og dens nøjagtighed. Vi påtager os intet ansvar for Feedback opslået af dig eller en tredjepart.
AFSNIT 12 - FEJL, UNØJAGTIGHEDER OG UDELADELSER

Du må ikke tilgå eller bruge Tjenesterne, direkte eller indirekte: (a) til ulovlige eller ondsindede formål; (b) til at overtræde internationale, føderale, provinsielle eller statslige regler, love eller lokale forordninger; (c) til at krænke vores intellektuelle ejendomsrettigheder eller andres intellektuelle ejendomsrettigheder; (d) til at chikanere, misbruge, fornærme, skade, bagvaske, bagtale, nedvurdere, intimidere eller skade vores medarbejdere eller andre personer; (e) til at transmittere falske eller vildledende oplysninger; (f) til at sende, bevidst modtage, uploade, downloade, bruge eller genbruge materiale, der ikke overholder disse Vilkår; (g) til at sende eller formidle reklame- eller salgsfremmende materiale, herunder "junkmail", "kædebreve", "spam" eller lignende; (h) til at udgive dig for eller forsøge at udgive dig for at være en anden person eller enhed; eller (i) til at engagere dig i enhver anden adfærd, der begrænser eller hæmmer nogens brug eller glæde af Tjenesterne, eller som efter vores vurdering kan skade Element Kunst, Shopify eller brugere af Tjenesterne.
Derudover accepterer du ikke at: (a) uploade eller transmittere varemærker, virus eller enhver anden form for ondsindet kode, der vil eller kan blive brugt på en måde, der vil påvirke funktionaliteten eller driften af Tjenesterne; (b) reproducere, duplikere, kopiere, sælge, videresælge eller udnytte nogen del af Tjenesterne; (c) indsamle eller spore andres personlige oplysninger; (d) spamme, phishe eller scrape tjenesterne; (e) bruge robotter, spidere, scraping, automatiske enheder eller processer, AI-værktøjer (såsom agentisk AI) til at tilgå Tjenesterne; eller (f) forstyrre, omgå eller afbryde sikkerhedsfunktionerne på Tjenesterne. Vi forbeholder os retten til at suspendere eller lukke din konto til enhver tid uden varsel, hvis vi vurderer, at du har overtrådt disse Vilkår.
AFSNIT 14 - AGENTER
14.1 Dette afsnit ("Agentvilkår") gælder, hvis du bruger eller tillader udrulning af en Agent til at tilgå eller interagere med Tjenesterne. "Agent" betyder enhver software eller tjeneste, der udfører autonome eller semi-autonome handlinger på vegne af eller efter instruktion fra en person eller enhed.

14.4 Agenter skal: (i) i alle HTTP/HTTPS-anmodninger identificere, at anmodningen er fra en Agent, ved at inkludere følgende i anmodningens user agent-streng: "Agent/[agentnavn]"; (ii) ikke skjule, at interaktionen kommer fra en Agent, såsom ved at efterligne menneskelig adfærd eller omgå CAPTCHAs; (iii) svare sandfærdigt på spørgsmål, der søger at afgøre, om interaktionen kommer fra et menneske eller en computer; (iv) ikke omgå foranstaltninger beregnet til at kontrollere Agenters adgang.
AFSNIT 15 - OPSIGELSE
Vi kan opsige denne aftale eller din adgang til Tjenesterne til enhver tid uden varsel efter eget skøn, og du vil forblive ansvarlig for alle skyldige beløb op til og med opsigelsesdatoen.
AFSNIT 16 - GARANTIFRASKRIVELSE
Oplysningerne på Tjenesterne stilles udelukkende til rådighed som generel information. Vi garanterer ikke for nøjagtigheden eller fuldstændigheden af disse oplysninger. Enhver tillid, du udviser over for sådanne oplysninger, sker udelukkende på egen risiko.

AFSNIT 17 - ANSVARSBEGRÆNSNING
I INTET TILFÆLDE SKAL Element Kunst, VORES PARTNERE, LEDERE, MEDARBEJDERE, AGENTER ELLER LEVERANDØRER, ELLER SHOPIFY OG DETS TILKNYTTEDE SELSKABER, VÆRE ANSVARLIGE FOR NOGEN SKADE, TAB, KRAV ELLER DIREKTE, INDIREKTE, HANDELIGE ELLER FØLGESKADER AF ENHVER ART, HERUNDER TABT FORTJENESTE, TABTE INDTÆGTER, TAB AF DATA ELLER ERSTATNINGSOMKOSTNINGER, DER OPSTÅR SOM FØLGE AF DIN BRUG AF TJENESTERNE ELLER PRODUKTER KØBT VIA TJENESTERNE.
AFSNIT 18 - SKADESLØSHOLDELSE
Du accepterer at skadesløsholde, forsvare og holde Element Kunst, Shopify og vores tilknyttede selskaber fri for ethvert krav eller krav, herunder rimelige advokatsalærer, som rejses af tredjepart på grund af eller som følge af din overtrædelse af disse Servicevilkår eller din overtrædelse af lovgivningen eller en tredjeparts rettigheder.
AFSNIT 19 - SVEJSBARHED (SEVERABILITY)
I tilfælde af at en bestemmelse i disse Servicevilkår fastslås at være ulovlig, ugyldig eller uigennemførlig, skal en sådan bestemmelse alligevel kunne håndhæves i videst muligt omfang tilladt efter gældende lovgivning, og den uigennemførlige del skal anses for at være adskilt fra disse Servicevilkår.
